Can adults grow cannabis at home in New York, and what about seeds?

New York's personal cultivation regulation permits people 21 years of age or older to cultivate cannabis for personal adult use, and only in or on the grounds of that person's private residence.

The state's published limits are three mature and three immature plants per adult, and no more than six mature and six immature plants per private residence, however many adults live there.

Personal cultivation does not authorise sale. Plants and harvested cannabis must be kept secure and out of reach of anyone under 21.

These rules are amended by the Cannabis Control Board, so confirm current plant limits, location and security requirements with OCM or qualified counsel before you cultivate. We do not publish guidance for growing beyond the legal limits, for growing anywhere other than a private residence, or for selling home-grown cannabis.
